This Privacy Policy governs your use of the Anatomyka software and mobile applications (collectively, the “Service”), including ATLAS and ATLAS PRO EDU mobile versions available on Google Play, App Store, and Huawei AppGallery, operated by Woodoo Art s.r.o. (registered at Mlynské Nivy 4121/1, 811 09 Bratislava, Slovak Republic) and desktop versions ACADEMIC PRO and ACADEMIC PRO EDU, operated by ANATOMYKA LLC (registered at 1111B S Governors Ave STE 21458, Dover, DE 19904, United States) (collectively, “us”, “we”, or “our”).
By accessing or using the Service, you agree to this Privacy Policy. If you do not agree, please do not use the Service. This Privacy Policy complies with the General Data Protection Regulation (GDPR) (EU) 2016/679 for users in the European Union.

1. Information We Collect

We collect the following personal data when you use the Service:

• Account Information: Name, email address, and billing address provided during registration on portal.anatomyka.com (for desktop versions ACADEMIC PRO and ACADEMIC PRO EDU) or through mobile app stores (Google Play, App Store, Huawei AppGallery for ATLAS and ATLAS PRO EDU).
• Payment Information: Payment details (e.g., credit card information) processed by third-party providers (Stripe, PayPal) for subscriptions or purchases.
• Usage Data: Technical data, such as device information (e.g., operating system, device type), IP address, and usage statistics (e.g., feature usage, session duration), collected to verify licenses and improve the Service.
• User-Generated Content: Content you create, such as ePosters, divided into:

1. Anatomyka ePosters: Interactive 3D content provided by us, including content based on Memorix Anatomy descriptions, protected by copyright. These are displayed to all users of the Service and may not be modified, copied, or distributed without our prior written consent.
2. Academic PRO EDU ePosters: Created under Commercial Licenses (ACADEMIC PRO EDU, ATLAS PRO EDU), which may be shared and published for educational purposes, subject to attribution to Anatomyka where feasible. You retain authorship rights, but grant us a non-exclusive, royalty-free license to use, modify, or display them for Service improvement or promotion, as outlined in our End User License Agreement (EULA).
3. Student ePosters: Created under Non-Commercial (ACADEMIC PRO) or School Individual Licenses (ATLAS), stored locally on your device for personal use only. Sharing, publishing, or distributing (including screenshots or videos) is prohibited.

• Cookies and Tracking Technologies: We use cookies or similar technologies (e.g., device IDs) to collect usage data, such as navigation patterns or feature usage, to verify licenses and improve the Service. We do not collect or process protected health information or patient data, as the Service is not intended for such purposes.

2. How We Use Your Information

We use your personal data for the following purposes:

• Account Management: To create and manage your account on portal.anatomyka.com (for desktop versions) or through Google Play, App Store, or Huawei AppGallery (for mobile versions ATLAS and ATLAS PRO EDU), verify your license (via continuous internet connection for desktop versions), and provide customer support.
• Payment Processing: To process subscription fees or one-time purchases via third-party providers (Stripe, PayPal).
• Service Improvement: To analyze usage data (anonymized where possible) and ePosters (e.g., for improving 3D model rendering or educational features) to enhance functionality, performance, and user experience.
• Content Sharing: To enable sharing of Academic PRO EDU ePosters for permitted purposes (e.g., educational use in ACADEMIC PRO EDU or ATLAS PRO EDU), provided they include attribution to Anatomyka where feasible. Commercial use of ePosters requires prior written consent (contact: info@anatomyka.com). Anatomyka ePosters are protected by copyright and may not be modified or shared. Student ePosters are restricted to personal use and cannot be shared or published.
• Communication: To send subscription renewal reminders (14 days prior to renewal), service updates, or respond to inquiries via email (support@anatomyka.com).
• Marketing Communications: With your explicit consent, we may send promotional emails about new features, offers, or updates to the Service. You can opt out at any time by clicking the unsubscribe link in our emails or contacting support@anatomyka.com.
• Legal Compliance: To comply with applicable laws, including GDPR, and to prevent unauthorized use or tampering with the Service.

3. Legal Basis for Processing (GDPR)

For users in the European Union, we process personal data based on:

• Contractual Necessity: To fulfill our obligations under the Terms of Service or End User License Agreement (EULA), such as providing access to the Service, processing payments, and enabling ePoster creation (GDPR Article 6(1)(b)).
• Legitimate Interests: To improve the Service, ensure security, and prevent fraud (e.g., license verification via continuous internet connection, analysis of ePoster usage) (GDPR Article 6(1)(f)).
• Consent: For data transfers to the United States, marketing communications, or cookie usage, where applicable (GDPR Article 6(1)(a)).

4. Data Sharing and Transfers

We share your personal data only as follows:

• Third-Party Providers: Payment processors (Stripe, PayPal) handle payment information securely. These providers have their own privacy policies.
• Cloud Service Providers: We use Amazon Web Services (AWS) to store and process personal data, including ePoster metadata and installation files (e.g., NSIS, .dmg, .apk), to operate the Service. AWS is contractually obligated to comply with GDPR and maintain appropriate security measures.
• ePoster Sharing: If you choose to share Academic PRO EDU ePosters (created under ACADEMIC PRO EDU or ATLAS PRO EDU, e.g., on social media or educational platforms), we may process them on our AWS servers to facilitate sharing, subject to the EULA’s attribution and usage restrictions. Anatomyka ePosters and Student ePosters are not shareable.
• International Transfers: For users in the EU, personal data, including ePoster metadata, may be transferred to the United States (ANATOMYKA LLC, AWS) for processing. We ensure such transfers comply with GDPR through standard contractual clauses or other safeguards. By using the Service, you consent to such transfers.

We do not sell or share your personal data or ePosters for marketing purposes without your explicit consent.

5. Your Data Protection Rights (GDPR)

If you are in the European Union, you have the following rights under GDPR:

• Access: Request a copy of your personal data, including ePoster metadata stored on our servers.
• Rectification: Correct inaccurate or incomplete data.
• Erasure: Request deletion of your data, including User-Generated ePosters (Academic PRO EDU and Student ePosters), subject to legal obligations. Anatomyka ePosters are protected by copyright and may not be erased.
• Restriction: Limit how we process your data.
• Objection: Object to processing based on legitimate interests.
• Data Portability: Receive your data, including exportable User-Generated ePosters, in a structured, machine-readable format.
• Withdraw Consent: Withdraw consent for data processing where applicable.

6. Data Retention

We retain your personal data only as long as necessary for the purposes outlined in this Privacy Policy:

• Account and payment data are retained for the duration of your subscription and up to 7 years thereafter to comply with tax and legal obligations.
• Usage data is retained in anonymized form for analytics unless you request deletion.
• User-Generated ePosters (Academic PRO EDU ePosters created under ACADEMIC PRO EDU or ATLAS PRO EDU, and Student ePosters) are stored until you delete them or your account is terminated. Shared Academic PRO EDU ePosters may remain on our AWS servers for the duration of their permitted use (e.g., educational sharing), unless you request erasure. Anatomyka ePosters are retained permanently as they are part of the Service and protected by copyright.

7. Security

We implement reasonable technical and organizational measures to protect your personal data and ePosters, including encryption for data transmission and secure storage on AWS. However, you are responsible for safeguarding your account credentials and ensuring ePosters do not contain sensitive information.

8. No Protected Health Information
The Service, including all ePosters (Anatomyka ePosters, Academic PRO EDU ePosters, and Student ePosters), is not intended to store, transmit, or process protected health information or patient data. You must not include such information in ePosters or other content, and we are not liable for any violations of health privacy laws (e.g., GDPR, HIPAA).

9. Portal Account

To use the Service, you must create an account on portal.anatomyka.com (for desktop versions ACADEMIC PRO and ACADEMIC PRO EDU) or through mobile app stores (Google Play, App Store, Huawei AppGallery for mobile versions ATLAS and ATLAS PRO EDU). You must provide accurate and complete information (e.g., name, email) and safeguard your password. You are responsible for all activities under your account and must not share your credentials with third parties. Unauthorized use or sharing of your account may result in immediate termination, as outlined in the EULA. Notify us immediately of any security breach at support@anatomyka.com.

10. Intellectual Property

The Service, including its 3D models, Anatomyka ePosters (including content based on Memorix Anatomy descriptions), textures, and other original content, is the exclusive property of Woodoo Art s.r.o., ANATOMYKA LLC, and their licensors (e.g., Memorix Anatomy). The Service is protected by copyright, trademark, and other intellectual property laws in the Slovak Republic, United States, and other jurisdictions. You retain ownership of your User-Generated ePosters (Academic PRO EDU ePosters created under ACADEMIC PRO EDU or ATLAS PRO EDU, and Student ePosters) but grant us a non-exclusive, royalty-free license to use, modify, or display them for Service improvement or promotion, as specified in the EULA. You may not use our trademarks or content, including Anatomyka ePosters, without prior written consent (contact: info@anatomyka.com).

11. Copyright Policy

We respect the intellectual property rights of others. If you believe that any content on the Service, including User-Generated ePosters, infringes your copyright, please submit a written notice to info@anatomyka.com, including:

• A description of the copyrighted work.
• The location of the infringing material on the Service.
• Your contact information and a statement that you are the copyright owner or authorized representative. We will respond promptly to valid notices and may remove infringing content. You may be liable for damages (including legal fees) if you misrepresent infringement claims. Anatomyka ePosters are protected by copyright and may not be infringed.

11.2 DMCA Notices (US Users)

For users in the United States, if you believe your copyright has been infringed, you may submit a notice under the Digital Millennium Copyright Act (DMCA) to info@anatomyka.com, including your signature, identification of the copyrighted work, location of the infringing material, and a statement of good faith belief. We will act promptly to address valid DMCA notices.

12. Refunds

Paid subscription fees for the Service (e.g., ATLAS, ATLAS PRO EDU, ACADEMIC PRO, ACADEMIC PRO EDU) are non-refundable, except where required by applicable law (e.g., EU consumer rights under Directive 2019/770). If you believe you are entitled to a refund, contact support@anatomyka.com within 14 days of purchase, providing your account details and reason for the request. Refunds are processed at our discretion, subject to legal obligations.

13. Third-Party Links

The Service may contain links to third-party websites or services (e.g., Stripe, PayPal, Memorix Anatomy, AWS, Google Play, App Store, Huawei AppGallery). We are not responsible for their privacy practices. We recommend reviewing their privacy policies before use.

14. Children’s Privacy

The Service is not intended for users under 16 years of age. We do not knowingly collect personal data or ePosters from children under 16. If we become aware of such data, we will delete it immediately.

14.2 COPPA Compliance (US Users)
For users in the United States, the Service complies with the Children’s Online Privacy Protection Act (COPPA). We do not knowingly collect personal data from children under 13. If we become aware of such data, we will delete it immediately. Contact support@anatomyka.com for concerns.

15. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. Material changes will be notified at least 30 days in advance via email or on our website (anatomyka.com). Your continued use of the Service after changes take effect constitutes your acceptance of the updated policy.
