These Terms of Service (“ToS”) govern your use of the Anatomyka software, mobile applications (collectively, the “Service”), and the website portal.anatomyka.com, including ATLAS and ATLAS PRO EDU mobile versions available on Google Play, App Store, and Huawei AppGallery, operated by Woodoo Art s.r.o. (registered at Mlynské Nivy 4121/1, 811 09 Bratislava, Slovak Republic) and desktop versions ACADEMIC PRO and ACADEMIC PRO EDU, operated by ANATOMYKA LLC (registered at 1111B S Governors Ave STE 21458, Dover, DE 19904, United States) (collectively, “us”, “we”, or “our”). By accessing or using the Service, you agree to these ToS, our End User License Agreement (EULA) at https://www.anatomyka.com/eula, and our Privacy Policy at https://www.anatomyka.com/privacy-policy. If you do not agree, please do not use the Service.
1. Eligibility and Account Registration
1.1 Eligibility: You must be at least 16 years old to use the Service. By using the Service, you represent that you meet this age requirement and have the legal capacity to enter into these ToS. For users in the United States, we comply with the Children’s Online Privacy Protection Act (COPPA) and do not knowingly allow users under 13 to use the Service.
1.2 Account Registration: To use the Service, you must create an account on portal.anatomyka.com (for desktop versions ACADEMIC PRO and ACADEMIC PRO EDU) or through Google Play, App Store, or Huawei AppGallery (for mobile versions ATLAS and ATLAS PRO EDU). You must provide accurate and complete information (e.g., name, email) and safeguard your account credentials. You are responsible for all activities under your account. Unauthorized sharing of credentials may result in immediate termination, as outlined in the EULA. Notify us of any security breach at support@anatomyka.com. For instructions on changing your password, recovering a forgotten password, or resolving issues with login or installation, refer to our FAQ at https://www.anatomyka.com/faq or contact support@anatomyka.com.
1.3 Additional Benefits: With the purchase of an Anatomyka ACADEMIC license (ACADEMIC PRO or ACADEMIC PRO EDU), you receive free access to the ATLAS mobile application (available on Google Play, App Store, and Huawei AppGallery) for the duration of your ACADEMIC license. To use ATLAS, you must download it from the respective app store and log in using the same account credentials created on portal.anatomyka.com. Additionally, you receive a one-month free trial of the Memorix application, subject to the same login requirements. These benefits are non-transferable and require a continuous internet connection for verification.
2. Use of the Service
2.1 Permitted Use: You may use the Service for personal (ACADEMIC PRO, ATLAS Individual) or educational/professional purposes (ACADEMIC PRO EDU, ATLAS PRO EDU), as specified in the EULA. The Service includes access to 3D models, Anatomyka ePosters (copyright-protected content provided by us, including Memorix Anatomy descriptions), and the ability to create User-Generated ePosters (Academic PRO EDU ePosters for sharing under Commercial Licenses, or Student ePosters for personal use only).
2.2 Prohibited Conduct: You agree not to:
- Engage in any illegal activities or violate any laws, including intellectual property laws, while using the Service.
- Copy, reproduce, capture screenshots, record videos, or distribute any content from the Service, including but not limited to 3D models, Anatomyka ePosters, textures, or any other proprietary materials, in any form or by any means, without our prior written consent (contact: info@anatomyka.com). This prohibition applies to all content generated or displayed by the Service, except for the permitted sharing of Academic PRO EDU ePosters as outlined in Section 2.3. Unauthorized copying, reproduction, or distribution may result in legal liability, including but not limited to civil damages, injunctive relief, and other remedies for intellectual property infringement, as well as immediate termination of your account as outlined in Section 5.2. Sharing of Academic PRO EDU ePosters is only permitted through the application by generating and distributing a link; creating screenshots, videos, or other derivatives for sharing is expressly prohibited.
- Share, publish, or distribute Student ePosters (including screenshots, videos, or any derivatives), as they are strictly limited to personal use under Non-Commercial (ACADEMIC PRO) or School Individual Licenses (ATLAS). Such actions may lead to legal consequences and account termination.
- Upload or share content (e.g., ePosters) containing protected health information, offensive material, or content that infringes third-party rights.
- Attempt to reverse-engineer, modify, or tamper with the Service, including 3D models or Anatomyka ePosters.
- Share your account credentials or allow unauthorized access to the Service.
- Upload Service content (e.g., ePosters, presentations) to learning management systems (LMS) or third-party platforms without our prior written consent (contact: info@anatomyka.com).
2.3 Content Sharing: Academic PRO EDU ePosters (created under ACADEMIC PRO EDU or ATLAS PRO EDU) may be shared or published for educational purposes solely through the Service by generating and distributing a link to the ePoster within the application, provided they include attribution to Anatomyka where feasible. Sharing via screenshots, videos, or other derivatives is strictly prohibited. Commercial use of Academic PRO EDU ePosters requires prior written consent (contact: info@anatomyka.com). Anatomyka ePosters and Student ePosters may not be shared or published.
2.4 ePoster Content Rules: For Commercial Licenses (ACADEMIC PRO EDU, ATLAS PRO EDU) that allow creation and sharing of Academic PRO EDU ePosters, all ePosters must relate solely to medical or educational themes. Any content that is non-medical, illegal, offensive, defamatory, or violates third-party rights is strictly prohibited. We reserve the right to review, remove, or delete any ePoster that violates these rules without notice or explanation.
3. Intellectual Property
3.1 Ownership: The Service, including 3D models, Anatomyka ePosters, textures, and other content, is owned by Woodoo Art s.r.o., ANATOMYKA LLC, and their licensors (e.g., Memorix Anatomy) and is protected by copyright, trademark, and other intellectual property laws. You retain ownership of your User-Generated ePosters but grant us a non-exclusive, royalty-free license to use, modify, or display them for Service improvement or promotion, as specified in the EULA.
3.2 Copyright Policy: If you believe any content on the Service, including User-Generated ePosters, infringes your copyright, submit a notice to info@anatomyka.com, as outlined in our Privacy Policy (Section 11). For U.S. users, we comply with the Digital Millennium Copyright Act (DMCA) for valid notices.
4. Payments and Refunds
4.1 Subscriptions and Fees: The Service requires payment of subscription fees for ACADEMIC PRO, ACADEMIC PRO EDU, ATLAS, or ATLAS PRO EDU, processed via third-party providers (Stripe, PayPal). Subscription fees are non-refundable, except as required by applicable law (e.g., EU consumer rights under Directive 2019/770). If you fail to cancel your subscription before the end of the subscription period, you will not be entitled to a refund for that period. In exceptional circumstances, refunds may be granted at our sole discretion following agreement with us (contact: support@anatomyka.com). For refund inquiries, contact support@anatomyka.com within 14 days of purchase, providing your account details and reason for the request.
4.2 Free Benefits: Free access to ATLAS with an ACADEMIC license and the one-month Memorix trial are included at no additional cost but are subject to the terms of the EULA and these ToS.
4.3 App Store and Google Play Refunds: For purchases made through the Apple App Store, refunds must be requested directly through Apple Support at https://support.apple.com/en-us/118223. We cannot process App Store refunds. For purchases made through Google Play, refunds can be requested through us by contacting support@anatomyka.com, providing your Google Purchase ID (see https://support.google.com/googleplay/answer/2479637?hl=en). We will process eligible requests in accordance with Google Play policies.
5. Termination
5.1 By You: You may terminate your account by contacting support@anatomyka.com. Upon termination, your access to the Service, including ATLAS and Memorix benefits, will end, and User-Generated ePosters may be deleted, subject to the Privacy Policy (Section 6).
5.2 By Us: We may suspend or terminate your account for violations of these ToS, the EULA, or applicable laws, including unauthorized sharing of credentials, uploading prohibited content, or failure to pay subscription fees. You will be notified via email, and access to the Service will be revoked.
5.3 Termination for Content Violations: We may terminate your account immediately, without refund or compensation, if you violate ePoster content rules (Section 2.4) or any other provision of these ToS, including but not limited to creating or sharing non-medical content. Upon termination, all access to the Service and shared ePosters will be revoked, and we may delete your User-Generated content without liability.
6. Data Protection
6.1 Privacy Policy: Your personal data, including account information, usage data, and User-Generated ePosters, is governed by our Privacy Policy at https://www.anatomyka.com/privacy-policy, which complies with GDPR for EU users. We do not collect protected health information, and you must not include such data in ePosters.
7. Limitation of Liability
7.1 To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the Service, including loss of data, ePosters, or profits. The Service is provided “as is” without warranties of any kind, except as required by applicable law.
8. Governing Law and Dispute Resolution
8.1 Governing Law: These ToS are governed by the laws of the Slovak Republic for ATLAS and ATLAS PRO EDU, and the laws of Delaware, United States, for ACADEMIC PRO and ACADEMIC PRO EDU, without regard to conflict of law principles.
8.2 Dispute Resolution: Any disputes arising from these ToS will be resolved through negotiation. If unresolved, disputes will be submitted to the competent courts in Bratislava, Slovak Republic (for ATLAS and ATLAS PRO EDU) or Dover, Delaware, United States (for ACADEMIC PRO and ACADEMIC PRO EDU).
9. Changes to These Terms
We may update these ToS from time to time. Material changes will be notified at least 30 days in advance via email or on our website (anatomyka.com). Your continued use of the Service after changes take effect constitutes your acceptance of the updated ToS.
